If his verdict is overturned, will he then be exonerated by the public and allowed to continue what passes for a career?

It's unlikely to be overturned though - he hasn't even been granted an appeal as far as I know although a review is on the cards. New evidence will be required and advertising to remunerate anyone who wants come forward with new information can hardly help his case? F*ck him and Oldham, horrible c*nt, horrible club, let them stink out the league together.

"Mild case of rape" - What a stupid comment.

At the moment, the guy is a convicted rapist and until proved otherwise, he should not be allowed to play for Oldham or any other professional club.

Wrong on so many levels.

Of course there are differing levels of seriousness when it comes to rape.

None of which should be described as 'mild'.

Unless you could describe exactly which way of a bloke b*ggering you without your consent you would class as 'mild'.

Classic emotive banality.

This is what the sentencing guideline says:
++++++++++++++++++++++
Culpability & Harm

All non-consensual offences involve the violation of the victim's sexual autonomy and will result in harm. The seriousness of the violation may depend on a number of factors, but the nature of the sexual behaviour will be the primary indicator of the degree of harm caused in the first instance.

The extreme youth or old age of a victim should be an aggravating factor. In addition, in principle, the younger the child and the greater the age gap between the offender and the victim, the higher the sentence should be. However, the youth and immaturity of the offender must also be taken into account in each case. All the non-consensual offences involve a high level of culpability on the part of the offender, since that person will have acted either deliberately without the victim's consent or without giving due consideration to whether the victim was able to or did, in fact, consent. The planning of an offence indicates a higher level of culpability than an opportunistic or impulsive offence.

I mean this quite genuinely Shaky.

As you imply, there are factors such as being assaulted in other ways, or by a number of people etc etc that will, of course, impact on the 'seriousness' of rape in terms of sentencing and so on.

But the reality to most women, is that the very fact of being raped by someone without consent is so appalling a breach of the basic trust between women and men (in that a man is almost always able to overpower a woman) that the other factors really do pale into insignificance.

Most women I know would rather be assaulted (obviously I do not include murder / manslaughter) rather than raped. And I suspect that the same would apply to men as well.

BTW from the full text of the sentencing guideline we see:

++++++++++++++++++++
Type/nature of activity: Single offence of rape by single offender

Starting points: 10 years custody if the victim is under 13
Sentencing ranges: 8 - 13 years custody

Starting points: 8 years custody if the victim is 13 or over but under 16
Sentencing ranges: 6 - 11 years custody

Starting points: 5 years custody if the victim is 16 or over
Sentencing ranges: 4 - 8 years custody
++++++++++++++++++++
Evans got 5 years ergo his offence was adjudged to be at the mild (** minor/negligible/gentle/slight) end of the spectrum.

Look, as terrible as rape may be be, it is obvious that for example the threat of or actual violence must significantly worsen that experience.

To deny that self evident fact is just not serious.

Sounds like she was a bit of a strumpet - I loved women like that when I was growing up, so what eh?

It is actual violence though, and at its most awful level.

It's a violence that may not, on the face of it, 'hurt' in the way that being cut with a knife hurts, but it is actual violence none the less.

It seems to me you are at least partially conflating violating and violence, but this discussion is pointless in so far as your basic position appears to be that it is impossible to distinguish between differing degrees of seriousness.

As we have seen that is certainly not the view of the law nor is it consistent with a rationalist perspective.

She didn't even know how she got to the Premier Inn, she awoke not even knowing where she was and had to ask the Hotel for CCTV footage to confirm - how in the world is she going to remember if she said yes or not? she then tweets her friends asking what car they want when she "wins big".

this is not your regular rape case with connotations of terror, fear and violence. Not that it matters in relation to this thread however.

Therein lies the point of the conviction. If what you say is true then she was in no state to consent. What she wrote on twitter has no bearing on that. Whatever your thoughts, the law as it stands has been applied. It would be interesting to know if you've looked at any of the case notes that are/were available.

If Oldham or another club sign CE and CE makes a decent comeback that would be interesting. Working in a highly paid or lowly paid job makes no difference. Thanks for the rational views above, I am off to the club shop. Have a good day on here and try not to vomit.
