The ECHR was designed to protect an individual's rights from the state, recently it has been interpreted by some in the legal profession as a tool to challenge the rights of the state to manage their affairs.
Migrants for example have no more rights than the individuals who are full citizens of a country, for some reason migrants are afforded more rights in the UK. The ECHR is not necessarily the issue, it's how we interpret it. Compare the rights that migrants get in France to the UK, both countries are signed up to the ECHR. |
